Petitioner has prayed for recovery of the articles which he claims was in the shop rooms wherein he was a tenant. To that effect, information was furnished with the police station. Accordingly, Bidhannagar East Police Station Case No. 124/24 dated 07.11.2024 was registered for investigation under section 3(5)/305(2)/324(4) of the BNS, 2023. Records reflect that the police authorities have submitted their final report declaring the case to be civil in nature.

Petitioner is aggrieved by the fact that there has been no recovery of the materials. However, since no case is till date existing and the informant was served with a notice under section 193(3)(iii) of BNSS, petitioner would prefer an application under section 193(9) before the learned ACJM, Bidhannagar.

Learned ACJM, Bidhannagar will consider the same in accordance with law and dispose of the same within a period of 6 (six) weeks from the date of filing of the application concerned.

With the aforesaid observations WPA 943 of 2025 is disposed of.

Case diary be returned to the learned advocate appearing for the State.
