The grievance of the petitioner is directed against refusal of the respondent authorities to provide a fresh electricity connection in favour of the petitioners at the subject premises.

The private respondent is represented and submits that there is a suit for declaration pending between the petitioners and the private respondents. The respondent licensing authority is represented and submits that they have no objection in providing a fresh electricity connection in favour of the petitioners.

I have heard the parties. I have also considered the submissions made on their behalf.

I am fully mindful that the petitioners seek an essential service.

Accordingly, the respondent statutory authorities are directed to provide a fresh electricity

connection to the petitioners upon compliance with all statutory formalities.

The respondent authorities are also granted liberty to take police assistance, if necessary, after payment of appropriate fees.

It is made clear that this order will not create any equity in favour of the petitioners in the pending suit pending between the petitioners and the private respondent.

With the aforesaid directions, WPA 917 of 2021 is disposed off.

The aforesaid exercise is to be completed by the respondent Distribution Company within a period of four weeks from date after compliance with all statutory formalities by the petitioners (Ravi Krishan Kapur, J.)
