Affidavit of service be kept with the records. Although, this Court has earlier directed the DSP, Birbhum to submit a report, the newly appointed I.O. has submitted such report dated February 8, 2023. It appears that investigation has been conducted afresh by Mr. Somnath Datta, of Mayureshwar P.S., now posted as SI, Illambazar P.S.

It appears that after investigation charge-sheet no. 348 of 2022 dated July 20, 2022, under Sections 447/448/323/325/354/302/34 of the Indian Penal Code, against twelve persons, five of whom have been arrested. Warrant of arrest and orders of proclamation and attachment have been obtained against the absconding persons.

The Court is satisfied with the new investigation. The report of the I.O. is kept with the records.

In the event the petitioner or any other witnesses require any protection to participate in the trial, the same shall be extended by Rampurhat Police Station. The writ petition shall stand disposed of.
