Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than two years and he is unnecessarily languishing in jail. Out of 15 witnesses cited by the prosecution, the evidence of the first witness is in progress. It has been submitted that other accused persons have already been released on bail. As such, the petitioner prays for bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the cross-examination of PW-1 has been deferred at the behest of the present petitioner and other accused persons. The bail of the petitioner was rejected by the Hon'ble Supreme Court on 02.07.2025 in Special Leave to Appeal (Crl.) No(s).

5580/2025. There are earlier rejections of this Hon'ble Court also.

Having considered the totality of the circumstances and the reasons so assigned in the earlier order passed in CRM (NDPS) 1727 of 2024, I am of the view that at this stage, this is not a fit case for releasing the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. However, having considered the period of detention of the petitioner, State is directed to expedite the progress of the trial.

The Memo of Evidence submitted by the State be kept with the record.

The application for bail, being CRM (NDPS) 104 of 2026, is, thus, disposed of.
