For the opposite parties The fundamental issue in this application is with regard to the disposal of an application under Order XXVI Rule 9 of the Code of Civil Procedure which is pending for a considerable period.

Since the opposite parties entered appearance through the learned advocate, service of notice upon the opposite parties stands dispensed with.

It is submitted that the suit is pending before the learned Judge, 6th Bench, City Civil Court, Calcutta, but there is no Presiding Officer posted.

Considering the facts and circumstances, the learned Judge (in-Charge), 6th Bench, City Civil Court, Calcutta, is requested to dispose of the application under Order XXVI Rule 9 of the Code of Civil Procedure pending

before the Court, as expeditiously as possible, if not on the date fixed for hearing of the application.

With the above observation, the revisional application, being CO 119 of 2023, stands disposed of. Learned advocates appearing on behalf of the parties are at liberty to bring this order to the notice of the learned Judge (in-Charge), 6th Bench, City Civil Court, Calcutta, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court without insisting upon production of a certified copy thereof.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
