09.03.2021 rc/ct.no.10 Item No.20 WPA No. 933 of 2021 Mr. Sobhan Majumder ...for the Petitioner Mr. Kanak Kiran Bandyopadhyay ....for the WBSEDCL The grievance of the petitioner is directed agianst the refusal on the part of the West Bengal State Electricity Distribution Company Limited, the respondent no. 1 herein to provide an electricity connection at the premises of the petitioner.

It is submitted on behalf of the petitioner that notwithstanding having made an application as far as back in 2016 no steps have been taken by the respondent authorities in providing the electricity connection to the petitioner.

The respondent authorities are represented and submit that there are private dispute between the parties and other locals who are not permitting the representatives of the respondent authorities to provide an electricity connection to the petitioner.

In the above circumstances the respondent authorities prays for appropriate police assistance in providing such electricity connection at the premises of the petitioner.

I am fully mindful that the right which the petitioner claim is a right to an essential service which the petitioner

is entitled to under the law subject to compliance with all necessary formalities in accordance with law. The local police authorities being the respondent no. 5 are directed to give all necessary assistance to the representatives of the respondent no. 1 in providing such fresh electricity connection at the premises of the petitioner.

It is made clear that all costs and statutory expenses will be exclusively borne by the petitioner.

With the aforesaid directions, WPA No. 933 of 2021 stands disposed of.

There shall, however, be no order as to costs. (Ravi Krishan Kapur,J)
