Affidavit of service filed by the petitioners is taken on record.

The respondents are not represented despite service. The petitioners allege that the private respondents have raised a pucca boundary wall in violation of Section 23(1) of the West Bengal Panchayat Act, 1973. The petitioners seek liberty to submit a comprehensive representation in this regard before the Pradhan, Bora Gram Panchayat, being the 6th respondent herein, and seek a direction upon the said authority to consider the same. Such liberty is granted.

The petitioners shall submit a comprehensive representation ventilating their grievance before the 6th respondent within 7 days from date. The 6th respondent is directed to consider and dispose of the same within six weeks from the date of receipt thereof upon affording reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law.

The decision taken by the authority shall be communicated to the petitioners within a week thereof. In the event the alleged construction is found to be illegal/unauthorized, the concerned authority shall take necessary steps in accordance with law.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
