The police authorities, however, on completion of investigation submitted a report in Final Form on or about 6.12.2023.

Having considered that the police authorities have submitted a report

disowning the accusations made, the petitioner would be at liberty to file an application under Section 173(8) of the Cr.P.C. before the learned CJM, Alipore.

Learned advocate for the petitioner submits that no notice was issued to the petitioner.

Accordingly, even if, an order has been passed, the petitioner may be granted an opportunity for invoking the provisions under Section 173(8) of the Cr.P.C. The learned Magistrate would dispose of the said application within 45 days of filing of the same.

With the aforesaid observations, WPA 796 of 2024 is disposed of.

Report submitted by the State be kept with the record. Let a copy of the report be handed over to the learned advocate for the petitioner.
