Criminal Revisional Jurisdiction 16-08-2023 Subha D/L 61 Ct no.34 CRR 117 of 2023 Biswajit Sakhari @ Sankhari -versus- Soma Sakhari and Anr.

Mr. Soumendra Nath Ghosh ....for the petitioner.

The revisional application has been preferred challenging the order passed by the learned Additional District and Sessions Judge, Kakdwip, 24 Parganas in Criminal Motion No. 06 of 2019. By the said order, the learned revisional court was pleased to modify the amount of maintenance and directed the petitioner/husband (herein) to pay a sum of Rs.3000/- per month to the wife and Rs.6000/- per month to the minor daughter aggregating to a sum of Rs.9000/- per month.

Having regard to the fact that both the courts being the learned Magistrate and the learned revisional court had the scope and opportunity to scan the evidence. The factum of marriage is admitted.

Having regard to the quantum so awarded, I am of the opinion considering the present market index no interference is called for. The petitioner/husband would be at liberty to take out an application under Section 127 of the Code of Criminal Procedure if he has material to produce for alteration of the maintenance amount.

No interference is called for in the judgement and order dated 24.08.2022 passed in Criminal Motion No. 06 of 2019 passed by the learned Additional Sessions Judge, 2nd Court, Kakdwip, South 24 Pgs.

With the aforesaid observations, the present criminal revisional application being CRR 117 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
