Learned counsel appearing on behalf of the petitioner submits as follows. The prime allegation is that a sum of Rs. 21 lakhs was given to the petitioner to invest in shares. But, the same was not done and the money was not returned. However, part payment was made. A notice has been issued to the petitioner and the petitioner apprehends that he would be arrested. The moment he goes to pray for anticipatory bail there. The rules for filing of anticipatory bail are different there and requires the personal presence of the petitioner there. Moreover, the petitioner's father is critically ill and the petitioner has to look after him.

Learned counsel appearing on behalf of the State relies on the report, which is taken on record and opposes the prayer for transit anticipatory bail.

It is the petitioner's case that his life and personal liberty would be at stake the moment he goes to the other State to pray for anticipatory bail. He has also tried to make out a case that he has to take care of his father who is critically ill. In view of the above and for the balance of convenience, let the petitioner not be arrested in connection with the instant case for a period of six weeks from this date.

In the meantime, the petitioner shall be at liberty to appear before or approach the learned jurisdictional Court and/or the Hon'ble High Court at Sikkim and pray for appropriate relief. The application for transit anticipatory bail is, accordingly, disposed of.
