Banerjee) ... for the petitioner Ms. Juin Dutta Chakraborty Mr. Bitan Modak ... for the respondent no. 8 The petitioner submits that he has purchased the property from one Sushil Kumar Mukherjee and he wants to repair the dilapidated building but the deed of conveyance, whatever be the nature of it, has not been executed because of death of Sushil Kumar Mukherjee. In the meantime two daughters of Sushil Kumar Mukherjee has filed an application for mutation before the respective municipality being the Kalyani Municipality.

I do not find any cause of action of the petitioner for repairing of the said building except interfering into the property under the garb of a court's order in this regard.

The writ application is ill motived and has not been filed with unclean hands.

The writ application is, therefore, dismissed. No costs.
