None appears on behalf of the respondents to oppose the application.

The Hon'ble Division Bench while admitting the appeal passed an ad interim order of injunction on August 21, 2007 to the following effect.

"Till the disposal of the application, let there be an interim order of status quo as on this date as regards possession and nature and character of the property."

I.A. No : CAN 1 of 2006 (Old No : CAN 2490 of 2006) is disposed of by making the said ad interim order absolute till the disposal of the present appeal, there shall be no order as to costs.

Re : S.A. 411 of 2007 Mr. Gopal Chandra Ghosh, learned advocate appearing on behalf of the appellant prays that leave may be granted to the appellant to prepare the paper book irrespective of arrival of Lower Court Records.

Prayer of Mr. Ghosh is allowed.

The appellant is permitted to prepare requisite number of paper books without certificate and without comparing with that of the original records, such paper book be prepared and filed within three weeks from date. (Biswajit Basu, J.)
