SA 133 of 2018 and CAN 3 of 2021 CAN 4 of 2022 AGM /RK Ct Aloke Kumar Sett & Ors VS Alok Kumar Datta & Ors With SA 134 of 2018 CAN 1 of 2018 (Old CAN 5733 of 2018) CAN 3 of 2021 CAN 4 of 2022 Aloke Kumar Sett & Ors Vs Alok Kumar Datta & Anr Mr. Debjit Mukherjee, ... For the Appellants.
Mr. Tanmoy Mukherjee, Mr. Souvik Das, ... For the respondents.
The application being CAN 4 of 2022 for compromise is taken up for consideration.
Mr. Debjit Mukherjee, learned advocate for the appellants submits that both the appeals have been settled outside the Court upon entering into certain terms. In the compromise application, both the parties to these appeals have put their respective signatures. Mr.
Tanmay Mukherjee, learned advocate appearing for the respondents submits that respondents have already received possession of the subject property, in terms of the settlement already reached
between the parties. The terms of the settlement is found incorporated in para 15 of this compromise application.
In view of the settlement/compromise being effected, for the terms set out in para 15, which appear to be lawful, there is hardly anything left for adjudication any more in these appeals.
Both the appeals are accordingly disposed of upon recording the compromise already effected between the parties.
The terms of the compromise do form part of the decree.
All the connected applications are thus disposed of.
