The petitioner was granted bail on January 19, 2024, inter alia, on the conditions that (i) he shall remain within the district of Uttar Dinajpur and (ii) he shall report to the Officer in charge, Dalkhola Police Station once in a week until further orders.

By way of the present application, the petitioner seeks relaxation of the aforesaid conditions. He says that his home is in Kishanganj, Bihar. He has not visited home for a very long time.

The State has filed a report. Let the same be kept with the records.

From the report, we do not find anything adverse about the petitioner. Since the petitioner has been complying with the conditions of bail and there does not appear to be any possibility of an early conclusion of the trial, we are inclined to relax the conditions of bail.

Accordingly, we waive the condition of bail directing the petitioner to remain within the district of Uttar Dinajpur. However, he shall not leave the State of West Bengal excepting for visiting his family in Kishanganj.

As regards the condition requiring him to report to the Officer-in-charge, Dalkhola Police Station once in a week is concerned, we relax the same and direct the petitioner to report to that Officer in-charge once in a month until further orders. We make it clear that the other conditions of bail remain unaltered. We reiterate that in the event the petitioner fails to attend even a single hearing before the learned Trial Court, the learned Trial Court will be entitled to cancel his bail without further reference to this Court.
