Special Court, Calcutta under the POCSO Act.

It has been submitted that the petitioner was earlier on bail.

The records of the case reflect that on 20th of June, 2023 and 1st of July, 2023, the petitioner was not present before the court, which compelled the ld. Special Court to issue warrant of arrest.

Ld. advocate for the State is present.

Ld. advocate for the petitioner undertakes that, henceforth, the petitioner will make herself present on each and every date before the ld. Special Court.

Under such circumstances, I direct that in case the petitioner appears and surrenders before the ld. trial court,

in that case, the ld. trial court would allow the petitioner to continue on the same bail and bond, if the petitioner was earlier on bail, provided she appears before the court by 30th of May, 2024.

In case, the petitioner do not appear by 30th of May, 2024, then, on the next working day, the ld. trial court would issue harsher process of law by adhering to Section 82 of the cr.p.c.

With the aforesaid observations, CRR 139 of 2024 along with CRAN 1 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
