16.01.2023 sdas rejected C.R.M. (NDPS) No. 58 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliachak Police Station Case No. 918 of 2021 dated 02.09.2021 under Section 22(c )/29 of the NDPS Act.

And In Re : Kamirul Sk. @ Karim ..... petitioner Mr. Kausik Biswas ... for the petitioner Mr. Sanjay Bardhan Mr. Santanu Chatterjee ... for the State Heard learned Counsels for the parties.

We have considered the materials on record. Statements of the witnesses show on the disclosure statement of the petitioner huge quantity of 61.5 grams of Yaba Tablets were recovered from the residence of the petitioner. His bail prayer was rejected earlier on merits.

Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
