Mr. Debjit Mukherjee, Mrs. Susmita Chatterjee, Mrs. Dipanwita Ganguly, Mr. K. Bhattacharya ...for the petitioners A direction to secure expeditious disposal of Title Suit No.141 of 2010, pending before the learned Civil Judge (Junior Division), 1st Court, Malda, is the ultimate relief sought for in this case.

Adverting to the order dated 17th September, 2022 passed in C.O.1631 of 2021, Mr. Mukherjee, learned advocate appearing for the petitioners submits that though there has been a direction passed requiring expeditious disposal of the suit without granting any unnecessary adjournment, preferably within June, 2022, but that direction could not be strictly complied with in the meantime.

No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite parties stands dispensed with.

When there is a direction as regards expeditious disposal of the suit, no further direction is called for. However, this Court reposes trust and confidence upon the court below to ensure expeditious disposal of the suit upon completion of argument, providing an opportunity to both the parties, subject to the suitability and convenience of the court below, preferably before the end of April, 2023, after causing disposal of interlocutory application, if there be any pending.

With this observation/direction, the revisional application stands disposed of.

Petitioners are directed to make communication of this order to the learned court below as well as to the opposite parties and their learned advocate in the court below.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
