The petitioner by profession is a Lawyer, while the respondent no.2 against whom the accusations have been made is a police officer.

State has submitted a report, which reflects that at the relevant point of time, CCTV footage was not active as there was a problem in optical fiber connectivity.

In view of the report so submitted by the Inspector-in-charge of Kaliachak Police Station, Malda not being satisfactory, the Superintendent of Police, Malda will conduct a fresh enquiry into the accusations so made. The outcome of the enquiry be communicated to the petitioner.

In case, the petitioner is dissatisfied with the outcome of the enquiry, the petitioner will be at liberty to file an application under Section 175(4) of the BNSS before the learned jurisdictional Magistrate.

With the aforesaid observations,

WPA 824 of 2024 is disposed of.

Report submitted by the State be kept with the record. Let a copy of the report be handed over to the learned advocate for the petitioner.
