Petitioner is aggrieved by the fact that inspite of directions passed in T.S. 605 of 2022 by the learned Civil Judge, (Junior Division), 2nd Court at Baruipur vide order dated 28.11.2022, wherein learned Court was pleased under Section 151 of C.P.C. to direct the Inspector-inCharge of Basanti Police Station to render police assistance to the plaintiff by following the due process of law for implementation of the interim order of injunction passed on 16.09.2022.

Learned advocate for the petitioner submits that inspite of such direction being passed the police authorities did not take any steps.

As none appears on behalf of the State Mr. Amit Kr. Ghosh, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. His appearance may be regularized by the concerned authorities.

In view of the grievance of the petitioner that the police authorities have not acted, I direct that the police authorities would respect, obey and implement the order of the learned Civil Judge (Junior Division) 2nd Court, Baruipur, if the same till date has not been altered, varied or modified by any higher forum.

With the aforesaid observations, WPA 842 of 2023 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
