Petitioner seeks cancellation of the order granting bail dated November 15, 2021 in C.R.M. 7105 of 2021.
State and the private opposite party are represented. Petitioner claims that the private opposite party was guilty of post bail misconduct. The order dated November 15, 2021 required the private opposite party not to enter the jurisdiction of Nowda police station. He submits that, the private opposite party violating such condition enter into such jurisdiction. He referred to the police complaint lodged.
We called for a report from the police on 30th January, 2023 on such aspect.
Report submitted in court be taken on record. Report dated January 31, 2021 states that the police again conducted local enquiry on January 30, 2023 and came to learn
that opposite party did not return to home under the Nowda Police Station. A certificate of the Pradhan was also relied upon. Under such circumstances, the allegations of post bail misconduct is not substantiated by the petitioner. Consequently, we find no ground to cancel the anticipatory bail granted to the petitioner.
