Learned advocate for the petitioner is aggrieved by the order dated 30-092020. I find that the said order was an ex parte order which was passed by the learned Judicial Magistrate, 5th Court, Paschim Medinipur in M. R. Case No. 320 of 2019. Learned advocate for the petitioner canvasses different issues on question of facts. This court while adjudicating the nature of the proceedings will enter into the question of facts provided the learned Magistrate had an occasion to deal with the same. If the grievance is in respect of the ex parte order it is for the petitioner to approach the learned Magistrate for setting aside the said ex parte order by invoking the regular statutory provisions which are available. No interference is made by this court.

With the aforesaid observations, the present revisional application being CRR 126 of 2023 is disposed of.
