It is said by the learned advocate on behalf of the petitioner that the accused petitioner is in custody since October 28, 2024. It is further said that this accused petitioner is completely innocent and is not involved in the offence alleged. Allegation lies against one Avimanna Mandal who hit the victim with the offending weapon and as a consequential effect, the victim expired. So he prays that the accused petitioner may be enlarged on bail.

Learned advocate for the State raises objection by submitting that after completion of investigation, charge sheet has already been submitted by the prosecution agency. There are sufficient incriminating materials in the case diary which show about prima facie involvement of the accused petitioner with the alleged offence. He prays that the petition filed by the petitioner praying for bail may be rejected.

Perused the materials on record. We have gone through the statement of the witnesses recorded under Section 164 of the Code of Criminal Procedure as well as other documents collected by the investigating agency. Keeping in mind his complicity in the alleged offence and after considering the seriousness of the offence, we are not inclined to enlarge the petitioner on bail, at this stage. 4.

The application for bail is, thus, rejected.
