Goutam Das v. State Of West Bengal

16.01.2023 sdas rejected C.R.M. (NDPS) No. 59 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Lalgola Police Station Case No. 523 of 2021 dated 19.07.2021 under Sections 20(b)(ii)(c ) of the NDPS Act.

And In Re : Goutam Das ..... petitioner Mr. Kallol Mondal ... for the petitioner Mr. Sanjay Bardhan Mr. Palash Chandra Majhi ... for the State Learned Counsel for the petitioner submits he is in custody for 1 and 1⁄2 years. He renews his prayer for bail. Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. 20.5 kg. of Ganja was recovered from the possession of the petitioner. His bail prayer was rejected earlier on merits. Date has been fixed for consideration of charge.

Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to consider the framing of charge at the earliest and in the event charge is framed to take the proceeding to its logical conclusion as expeditiously as possible

without granting unnecessary adjournments to either of the parties.
