Nasiruddin Gazi v. State Of West Bengal
C.R.M. (NDPS) 62 of 2022 (Via Video Conference) (AD) 28.01.2022 Court No.29 (Rejected) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with N 108/2020 arising out of Haroa P.S. Case No.372 of 2021 dated 29/08/2021 under Section 21(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
And In the matter of: Nasiruddin Gazi ....petitioner.
Mr. Angshuman Chakraborty ...for the petitioner.
Mr. Binay Panda Ms. Puspita Saha ... for the State.
Petitioner seeks bail.
Learned Advocate appearing for the petitioner submits that the chemical report is yet to be submitted. Learned Advocate appearing for the State submits that commercial quantity of narcotics was seized from the possession of the petitioner.
Considering the fact that the commercial quantity of narcotics was seized from the possession of the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, the prayer for bail of the petitioner is rejected. The prosecution will, however, to take expeditious steps for the purpose of obtaining the chemical report and submitting
the same before the jurisdictional Court.
C.R.M. (NDPS) 62 of 2022 is dismissed.
