Jannat Ul Firdous Mr. Rajsekhar Hota Ms. Bagisha Basak ...for the Petitioner This is an application wherein the petitioner has challenged the impugned order dated 2nd January, 2026 by which the court below had issued warrant of arrest against the present petitioner.

Being aggrieved by the aforesaid proceeding, learned counsel for the petitioner submits that the petitioner preferred an application for anticipatory bail before this High Court and while disposing the application for anticipatory bail in CRM(A) 3718 of 2025 dated 1.12.2025, this High Court granted him bail and also imposed condition inter alia that the petitioner shall meet the Investigating Officer once in a fortnight till submission of report in final form. Thereafter, the petitioner surrendered before the court below and obtained regular bail. In the meantime, he was suffering from "Dengue" and for which he could not meet with the Investigating Officer in compliance with the said order. Learned court below on receipt of a report from the Investigating Officer, had issued warrant of arrest against the present petitioner by the impugned order on the

ground of violation of condition imposed by this court dated 1st December, 2025.

However, learned counsel for the petitioner submits that he wants to surrender before the court below and also seeks to grant leave.

Having heard learned counsel for the petitioner and that the prayer made by the petitioner is innocuous and if it is allowed, the opposite party will have no cause to prejudice, the service of copy of the application upon the opposite party are dispensed with.

In view of the aforesaid submission made on behalf of petitioner, CRR 178 of 2026 is hereby disposed of giving liberty to the petitioner to surrender before the court below within a period of two weeks from the date of communication of the order and in the event such surrender, the court below will dispose of his prayer in accordance with law without being influenced by any observations made herein.

The impugned order dated 2nd January, 2026 which pertains to the issuance of warrant of arrest against the petitioner, is hereby stayed for a period of two weeks or till the petitioner surrenders before the court below, whichever is earlier.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
