The petitioner's case is that it is a compassionate appointment which ultimately processed by the School Service Commission and the School Service Commission recommended the name of the petitioner under the category SC though the petitioner is a candidate of OBC A category. The West Bengal Board of Secondary Education has also issued one appointment letter to the petitioner in the category of SC which is also required to be changed.

I direct the Secretary of the West Bengal Central School Service Commission to take steps for

modification of the appointment letter after giving an opportunity of hearing to the petitioner within a period of six weeks from date. If it is found that there is a vacancy in OBC A category the Commission will take appropriate steps for recommending the name of the petitioner for compassionate appointment for the post of clerk. If the Commission passes such an order in favour of the petitioner the West Bengal Board of Secondary Education will also issue appointment letter in consonance with the recommendation of the School Service Commission. The present recommendation and the appointment letter has no effect and are set aside. This writ application is disposed of.
