In spite of service of notice upon the appellant, the appellant is not represented. The second appeal is of the year 2012. No attempt was made for admission of the second appeal.

Learned Counsel appearing on behalf of the appellant has on the previous occasions retired from the matter due to lack of instruction.

We have carefully read the judgment and order of the Trial Court as well as the First Appellate Court. The appellate decree affirming the decree of the Trial Court is under challenge. The suit was filed for partition. On the basis of the oral and documentary evidence considered at length meticulously by the Trial Court, the suit was decreed in part. The First Appellate Court affirmed the decree. No substantial question of law is involved in the second appeal.

Accordingly, the second appeal being SA 65 of 2012 stands dismissed at the admission stage.
