Mukherjee ...for the respondent nos. 13 and 14 Mr. Arindam Sen, Mr. Rishav Gupta ...for the SLSA The petitioner claims that the private respondent/accused in Rajapur Police Station Case No. 246 of 2022 is threatening and intimidating the victim girl, who is a minor, aged about 15 years at the time of registration of the FIR.

A Hon'ble Division Bench of this Court has recorded in an order under Section 438 of the Cr. P.C. dated November 30, 2022 in CRM (A) 5559 of that the victim and the private respondent/accused accused had a love affair and the victim had voluntarily resided with the accused as husband and wife.

The accused undertakes before this Court not to come into contact with the victim or her family members.

In the event of any further complaint to the police, appropriate protection may be afforded to the petitioner and the victim girl.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
