Affidavit of service so filed be kept with the record. Mr. Jha, learned advocate appears for the petitioners. Mr. Dey, learned advocate appears for the private opposite party.

Ms. Faria Hossain, learned advocate appears for the State. It is the admitted position as has been submitted by the learned advocate appearing on behalf of the parties that the evidence before charge is completed and the next date has been fixed by the learned Trial Court for consideration of charges. In view of the advanced stage of the case, I am of the opinion that it would not be prudent for this Court to enter into the maintainability of the complaint, as there is already evidence on record although before charge, recorded by the jurisdictional Court.

The petitioner would be at liberty to agitate the points canvassed in the revisional application before the Learned Trial Court at the stage of consideration of charge. With the aforesaid observations, CRR 142 of 2022 is disposed of.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
