The petitioner claims to have worked as a Sweeper-cumwater Carrier in the office of the Revenue Inspector, Sahapur-II Gram Panchayat. The documents in the writ application clearly indicate that the office of the B.L.& L.R.O, G-II, Uttar Dinajpur had vide communication dated 17th July, 2017 and 8th January, 2018 respectively informed the S.D.L.R.O., Islampur, Uttar Dinajpur that the appointed Sweeper-cum-water Carrier in Sahapur-II Gram Panchayat did not join the post and fresh recruitment was proposed. The petitioner claims to have worked from February, 2017 at the said Gram Panchayat as Sweepercum-water Carrier. It is clear that the petitioner was not recruited or appointed after regular selection process. The petitioner has not been able to demonstrate as to how he has worked in the Gram Panchayat in question.

The petitioner not having been able to prove his locus, the question of his being considered for eligibility under the circular of September, 2011, therefore, does not and cannot arise.

For the reasons stated hereinabove, the writ petition fails and is hereby dismissed.

There shall be no order as to costs.
