The writ petitioner complains of inaction by the Liluah Police Station in respect of a complaint dated 1st December 2021 filed against the private respondent. Learned counsel for the State has produced a report in the form of instructions issued by the Officerin-Charge, Liluah Police Station addressed to the learned State Advocate and the same is taken on record. Learned counsel for the State submits that upon receipt of the petitioner's complaint, due inquires were made and the allegations of the writ petitioner were found to be prima facie correct. An FIR being Liluah Police Station Case No.44/22 dated 23rd January 2022 under Sections 406/420 of the Indian Penal Code is under investigation. Notices have also been issued under Section 41A to the writ petitioner.

A copy of such report may be made available to the learned counsel for the writ petitioner.

This Court, therefore, sees no inaction on the part of the police.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

Since the respondents have not used any affidavits, the allegations made in the writ petition, shall not be deemed to have been admitted by them.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
