The writ petition was preferred as there was 08.05.2025 Court No. 35 Item No.171 Rakib grievance of the petitioner, particularly with regard to a sewerage system being constructed. Petitioner alleges that she was abused, threatened and inspite of informing the police authorities no steps were taken.

Mr. Ghosh, learned advocate appearing for the State has submitted a report. Report reflects that the genesis of the case relate to nine decimals of land. A title suit being T.S. 133/2007 was filed before the learned Civil Judge (Junior Division), 1st Court, Krishnagar, Nadia where there were directions for not creating any disturbances in the petitioner's enjoyment and possession of the suit property. As a result of the petitioner and the private respondents being at loggerhead, proceedings have been drawn under Sections 107/116 (C) of the Code of Criminal Procedure.

Having regard to the steps taken, so far as the authority of the police officer is concerned, I am of the view that there was neither any inaction nor any excesses being inflicted. The Civil Court is in seisin of the issue, as

such if the petitioner faces inconveniences she should approach the Civil Court for a direction upon the police authorities to act in a particular manner.

Having considered that the incidents complained of are of the year 2023, I am of the opinion that if the petitioner faces any inconveniences, she would approach the Kotwali Police Station, Nadia, the concerned Inspector-in-Charge would take steps in accordance with law.

With the aforesaid observations WPA 837 of 2024 is disposed of.

Report so submitted by the State be kept with the record.
