Learned advocate for the State has submitted a report to acknowledge the fact that two witnesses have been examined. The contents of the evidence of the said two witnesses prima facie reflect that they are supporting the prosecution's case, although, they were not declared hostile. Having regard to the same and the fact that the petitioner is in custody for more than 10 months as also the fact that the evidence of the said two witnesses for the time being dilutes the situation, I am of the view that further incarceration of the present petitioner is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Narayan Mondal shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Additional District & Sessions Judge, 5th Court at Murshidabad at Berhampore.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court.

Accordingly, CRM(NDPS) 112 of 2026 is allowed. Pending application(s), if any, is also disposed of. The observation made hereinabove is only for the limited purposes of bail and shall not stand in the way of the learned trial court at the time of final stages of the case. Report submitted be kept with the record.
