Learned advocate appearing for the petitioner submits that petitioner has been arrested on the basis of the statement of the coaccused and there has been no recovery from the possession of the present petitioner, although, the subject matter of the case relates to recovery of certain country made one shutter. Learned advocate for the State opposes the prayer for bail and submits that there were two seizures in the present case. So far as the present petitioner is concerned five rounds of 8 mm ammunition were recovered pursuant to the petitioner being taken in custody in connection with the instant case. Petitioner has similar other cases wherein one shutter and ammunition were recovered. There are Call Data Records and money transactions in respect of the arms dealing.

Having considered the nature of the offences and the complicity of the present petitioner, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (M) 159 of 2026 is dismissed.
