The present application for recording compromise has been filed jointly by both the parties to the appeal. The appeal arises out of a decree of divorce obtained by the appellant/petitioner No. 1 -wife with a direction to pay alimony at the rate of Rs.2,500/- per month, which was later enhanced to Rs.5,000/- per month.

Learned Counsel for the petitioner No. 1 appears and submits that the parties have resolved the disputes between themselves upon agreement that the petitioner No. 2 (respondent) shall hand over a sum of Rs.6.5 lakhs lump sum to the appellant as a term of the compromise, which amount is settled and accepted by the appellant. We find from the application that the said compromise petition is valid

in the eye of law and records comprehensively the terms and conditions of the settlement to be arrived at between the parties.

Since the application has been signed by both the parties and their learned advocates and is otherwise in form, we accept the same.

Accordingly, FA 356 of 2006 along with CAN 3 of 2025 are disposed of in terms of the compromise as contained in CAN 3 of 2025 without any order as to costs.

The terms contained in the application bearing CAN 3 of 2025 be treated to be a part of the compromise decree.

6.

A formal decree be drawn up accordingly.
