The present application has been preferred by the petitioner in connection with Malda Police Station Case No.424 of 2021 dated 29.08.2021 under Section4 of the Protection of Children from Sexual Offences Act, 2012, praying for bail. Heard the learned lawyers for the petitioner and the State. Perused the C.D. The statement of the victim girl, recorded under Section 164, Cr.P.C. and the statement of her mother consistently implicate the petitioner in the alleged offence. The victim is a minor. Although medical examination has been refused, yet other elements in the case implicate the present petitioner in the alleged offence. Chargesheet has been submitted. The petitioner is in custody for 121 days. However, considering the seriousness of the offence and incriminating materials appearing against the petitioner, we are not inclined to allow bail to the present petitioner. Accordingly, the bail application stands rejected at this stage.

We direct the learned Trial Court to consider charge within a period of fifteen days from the date of communication of this order. In case charge is framed, the learned Trial Court shall conclude trial preferably within a period of eight months from the date of framing charges.

The application for bail, being CRM (DB) 143 of 2022 is dismissed.
