The petitioner challenges the auction notice published by the West Bengal Mineral Development and Trading Corporation Limited for selection of mine developer and operator (MDO) of sand blocks in West Bengal (Annexure P7, p.68). 2.

It is the specific case of the petitioner that the details of the sand block sought to be auctioned is not mentioned properly in the auction notice. According to the petitioner, the entire river Damador has been mentioned as the sand block for auction, which is not true. An objection was raised by the petitioner on January 2, 2025 and the same is alleged to be kept pending.

From the Bid Data Sheet & Bid Schedule annexed to the writ petition, it appears that the last date/time for submission of documents in connection with the bid scheduled on January 16, 2025, is over. The tender document was published in the website on December 20, 2024.

The auction is due to be conducted day after tomorrow (24th January, 2024) at 10 a.m. The petitioner has not submitted his bid.

Learned counsel appearing for the third respondent denies the allegation of the petitioner and submits that the geo-reference coordinate of the sand block which has been put up in auction is already annexed to the writ petition at page 71. The latitude and longitude of the area put to auction is mentioned therein.

On a perusal of the documents annexed to the writ petition and upon hearing the submissions made on behalf of the respective parties, it appears that the grievance of the petitioner is unsubstantiated. The details of the sand block which has been put up in auction, including its latitude and longitude, has been published by the tender inviting authority.

In view of the above, no relief as prayed for can be allowed to the petitioner in the instant writ petition. The writ petition fails and is hereby dismissed.
