Learned Advocate appearing for the petitioner submits that the petitioner is in custody for 76 days. The police filed charge-sheet and, therefore, further detention of the petitioner is not required.

Learned Advocate appearing for the State draws the attention of the Court to the statement recorded under Section 161 of the mother of the victim and to the post mortem report. Considering the gravity of the offence and the involvement of the petitioner therein as prima facie appearing from the materials in the case diary and considering the period of detention, we are unable to grant bail to the petitioner at this stage.
