Learned advocate appearing for the petitioner submits that in spite of the submissions of the State, till date the case has not been committed to the court of sessions. Petitioner is in custody for more than six months. The marriage between the petitioner and the deceased took place in the year 2021.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.

I have taken into account the post mortem report attention of which was drawn by the learned advocate for the State. Having considered the period of detention of the present petitioner, the overall circumstances of the case and without entering into the merits of the case, I am inclined to release the petitioner on bail solely on the ground of

detention and the fact that prosecution intends to examine number of witnesses in support of its case which is not possible within a reasonable period of time. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Jaydeb Mandal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Howrah.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of the district of Howrah without prior permission of the learned Trial Court. The application for bail, being CRM (M) 160 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
