In the instant case, the petitioner has prayed for expeditious disposal of Miscellaneous Case No. 7/2012 pending before the learned Civil Judge (Junior Division) 1st Court at Barasat.
Although no notice upon the learned advocate for the opposite parties was served in the matter, to consider the prayer as made by learned advocate for the petitioner, this court is of the view that such prayer if granted will not cause prejudice to the opposite parties. Learned advocate for the petitioner also submits that although this case is pending for long period, but the learned court below has not taken up any steps to dispose of this pre-emption case.
Learned advocate for the petitioner files a bunch of orders which is taken on record and draws the attention of the court that the matter
last appeared on 29.10.2022 and thereafter fixed the matter after a period of 10 months that is on 5.8.2023.
Upon perusing the petition and the orders passed by the learned court below, this court is of the view that as the case is pending for more than 10 years it should be disposed of as expeditiously as possible.
Learned court below is requested to dispose of the above Misc. case No. 7/2012 by 31st December, without granting any unnecessary adjournment.
The revisional application stands disposed of.
