Report submitted by the police authorities reflects that Pandua P.S. Case No. 636 of 2023 dated 22.11.2023 was registered for investigation under relevant Sections IPC and consequently charge-sheet was submitted.

This Court on 5.12.2024 directed the police authorities to file a fresh a report over the issue of the petitioner

being harassed and subjected to immense torture. Pursuant to which an enquiry was conducted by a lady police officer in the rank of Sub-Inspector of Police which revealed that there is a dispute over a property and the private respondents are involved in threatening and using abusive languages. A report, to that extent, has been prepared by the concerned officer.

In view petitioner's contention being fortified by an enquiry conducted by a police officer as also the fact that already a criminal case is pending before the learned jurisdictional Court being Pandua P.S. Case No. 636 of 2023, I direct that, in case, bail has been granted to the private respondents, the learned Magistrate on an application by the complainant will modify the order bail after hearing private respondents to the extent that if there has been any violation of the condition of bail being granted they should stay outside the

jurisdiction of Pandua police station.

If such application is filed at the instance of the present petitioner, the learned Magistrate in seisin aforesaid case would dispose of the same within a period of a fortnight from the date of filing of such application after affording an opportunity of hearing to all the necessary parties.

With the aforesaid observations, WPA 886 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
