Ruma Bhowmick nee Shaw .......Petitioner Mr. Ramashis Mukherjee Mr. Rameshwar Sinha Ms. Debanjana Sen ...for the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of ACM 222 of 2014 under Section 125 of the Code of Criminal Procedure pending before the learned Judicial Magistrate, 2nd Court, Alipore, South 24 Parganas, the matter may be disposed of without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.
It appears that the application filed by the petitioner under Section 125 of the Code of Criminal Procedure was allowed ex parte by an order passed on December 29, 2024. The private opposite party filed an application under Section 126(2) of the Code of Criminal Procedure which was allowed with cost of Rs.1000/- vide an order dated February 25, 2016 and the miscellaneous case was restored to its original file and number. The opposite party failed to appear before the learned Court on several occasions for which the application under Section 126(2) of the Code of Criminal Procedure was again rejected by the learned Magistrate vide an order dated August 01, 2024. It is not clear as to how the application was rejected subsequently after it was allowed by an order dated February 25, 2016. However,
appearance of the opposite party was accepted by the learned Magistrate thereafter but the case is still pending. Keeping in mind the age of the proceedings, the learned trial Court is directed to take the proceedings to its logical conclusion within 4 months from the next date of hearing fixed before him upon hearing both the parties and without granting any unnecessary adjournment to either of the parties, in accordance with law.
With the above observations and directions the instant revisional application being CRR No. 209 of 2025 is disposed of. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
