The petitioner claims to be running a brickfield under the name and style of M/s. Keota Brickfield Private Limited. The petitioner claims that he is running the said brickfield after obtaining necessary permission from the concerned authority and by complying with the provisions for running the said brickfield.
The immediate grievance of the petitioner is that the authorities are not accepting the Royalty from the petitioner on and from January 1, 2026. The petitioner claims to have submitted two
representations dated November 17, 2025 and December 18, 2025 requesting the authorities to let the petitioner have access to the portal for the purpose of payment of Royalty.
Learned advocate appearing for the petitioner submits that in spite of receipt of such representation, no decision has been communicated to the petitioner till date.
Mr. Mahata, learned AGP, submits that there are several allegations against the petitioner for which the respondent authorities are not accepting the Royalty from the petitioner. However, it is not in dispute that no decision in that regard has been communicated to the petitioner.
If the authorities are of the view that the petitioner has not complied with any formality or for other reasons Royalty cannot be accepted, it is the duty of the respondent authorities to communicate their decision to the petitioner.
Since no decision in that regard has been communicated to the petitioner, the Additional District Magistrate & District Land and Land Reforms Officer, Hooghly, being the respondent no. 3 herein, is directed to consider the prayer of the petitioner for payment of Royalty and pass a reasoned order on
such issue which shall be communicated to the petitioner.
At this stage Mr. Mahata, learned AGP, submits that no representation has been submitted before the Additional District Magistrate & District Land and Land Reforms Officer, Hooghly.
In view thereof, this writ petition stands disposed of by giving liberty to the petitioner to submit a comprehensive representation before the Additional District Magistrate & District Land and Land Reforms Officer, Hooghly, being the respondent no. 3, ventilating the grievances and, if such a representation along with a server copy of this order, is submitted, the 3rd respondent shall consider and dispose of such representation by passing a reasoned order after giving an opportunity of hearing to the petitioner or his authorized representative and communicate the reasoned order to the petitioner immediately thereafter. The entire exercise shall be completed by the Additional District Magistrate & District Land and Land Reforms Officer, Hooghly as expeditiously as possible but positively within a period of six weeks from the date of receipt of such representation along with a server copy of this order.
