Mr. Sarwar Jahan ...for the Petitioner Mr. Rana Mukherjee Mr. Sabir Ahmed ......for the State This habeas corpus petition is preferred at the instance of the father of a girl aged below eighteen years, who went missing.

A contemporaneous complaint was lodged with the concerned Police Station which yielded no result that compelled the father of the missing girl to approach this Court with the present application seeking direction in the nature of habeas corpus.

When this habeas corpus petition is taken up for hearing, it has been submitted by Mr. Jahan, learned Advocate for the petitioner that the girl of the petitoner has been recovered and he does not want to proceed with the present petition.

Mr. Rana Mukherjee, learned Additional Public Prosecutor with Mr. Sabir Ahmed, learned Counsel appear on behalf of the State-respondents submits that

due to recovery of the missing girl during pendency of the habeas corpus petition the petition needs to be disposed of since it has become infructuous.

Considering the submissions made on behalf of the parties, the habeas corpus petition stands disposed of in consideration of the fact that the missing daughter of the petitioner was recovered during pendency of this habeas corpus petition.

WPA(H)2 of 2021 stands disposed of.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties on compliance of necessary formalities.
