The petitioners have been implicated in the instant case under the provision of the Protection of Women from Domestic Violence Act, 2005. The grievance of the petitioners is that the case was initiated in the year 2015 and only the evidence of the applicant is over. On some reason or the other, the applicant being the opposite party is taking time. The petitioners submit that after getting interim maintenance, the opposite party is not willing to conclude the trial of the case. It is submitted that the next date has been fixed on 23.06.2023.

Having regard to the plight expressed by the petitioners, I direct the learned Magistrate to exercise the discretion for allotting specific dates so that a case of the year 2015 can be concluded within a reasonable period of time. No unnecessary adjournment for the said purpose should be granted to either of the parties. The main application should be given some precedence over the execution case, if any pending. All efforts must be taken by the parties so that the trial concludes within a reasonable period of time.

With the aforesaid observations, the revisional application being CRR 131 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
