1. Learned advocate representing the State respondents submits that employee was working under Directorate of Diary Development, Government of West Bengal and service of the employee was governed by West Bengal Service Rules. It also appears from the submission made on behalf of the petitioner that petitioner is claiming certain benefits due to death of his father.

2. Writ petition is not maintainable at this stage.

3. Petitioner needs to approach West Bengal Administrative Tribunal in pursuit of remedy.

4. Hence, writ petition stands dismissed.

5. However, this order shall not preclude the petitioner to take steps for claiming identical benefit before the Tribunal.

6. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
