1. By way of filing this writ petition the petitioner alleges that a public drain has encroached upon and construction has been made thereat. The representation given by the petitioner has been acted upon by the Executive Engineer, PWD, Diamond Harbour Division by forwarding the same to the Block Land & Land Reforms Officer, Diamond Harbour-II, South 24 Parganas by communication dated 24.1.2024 requesting for demarcation of the property in question in the presence of the PWD Officials. It is not clear as to whether such demarcation has taken place as of today. In any event, since the matter is now under the purview of the Block Land & Land Reforms Officer, Diamond Harbour, we direct the said authority to demarcate the land in question in the presence of the PWD officials within two

weeks from the date of receipt of the server copy of this order and if it is found that there is encroachment appropriate action be taken in accordance with law. The District Magistrate, South 24 Parganas is requested to monitor the progress of the matter.

2. With the aforesaid direction, this writ petition is disposed of.
