1.The petitioner in the instant case has challenged inter alia, the inaction on the part of the State Transport Authority, West Bengal to counter sign the petitioner's valid renewed Permanent Stage Carriage Permit No. 46-G-2016 (Renewal Permit No. 45-R-2021) issued by the State Transport Authority, Odisha for operation of the petitioner's vehicle being Registration no. OD-01AJ-2334 on the duly notified inter-State route Bhubaneswar-Moyna via Laxmannath and back.

2. The route has been incorporated under the Reciprocal Transport Agreement dated 12.9.2011 between the State of Orisha and West Bengal under Section 88(6) of the Motor Vehicles Act, 1988.

3. The petitioner made a representation before the respondent no. 2 on 24.12. 2025 for countersignature of the Permanent Stage Carriage Permit being no. No. 46-G-2016 (Renewal Permit No. 45-R-2021) but the same remains pending for consideration.

4. The State respondents does not object to the contention of the petitioner.

5. After hearing the parties at the length and considering the materials available on record, I direct the respondent no. 2 to consider the representation dated 24.12.2025 along with a letter dated 22.5.2024 issued by the State Transport Authority, Odisha within a period of sixty days from the date of communication of this order by passing a reasoned order in accordance with law upon affording an opportunity of hearing to the petitioner as well as the interested persons and communicate the decision within a week thereafter.

However, it is made clear, if the arrear dues along with the present dues is being cleared by the petitioner, the Secretary, State Transport Authority, West Bengal shall forthwith counter sign the permit in the light of the letter dated 22.5.2025 and allow the petitioner's vehicle to ply in the route in question as mentioned in the Reciprocal Transport Agreement dated 12.9.2011.

7. The writ petition stands disposed of without taking an exception to the merits of the case.

8. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
