The present revisional application has been preferred in respect of Complaint Case No. 1137 of 2015 under Sections 138/141 of the Negotiable Instruments Act which is pending before the learned Judicial Magistrate, 1st Court, Howrah. I have considered the submissions of the learned advocate appearing for the petitioner and I find that in the present case, examination under Section 251 of the Code of Criminal Procedure was over and subsequently the examination-in-chief of PW-1 was in progress when the petitioner approached this Court. Having regard to the advance stage of the case, I am not inclined to invoke my jurisdiction under Section 482 of the Code of Criminal Procedure. The petitioner would be at liberty to canvass her points advanced in the present revisional application at the appropriate stage of the trial.

With the aforesaid observations, the revisional application being CRR 133 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
