It appears that out of five private respondents, four could be served with notice.

Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. The private respondents had come up with illegal construction over public land belonging to the Collector and the same are blocking the ingress and egress to the petitioner's property.

The petitioner made a representation in this regard on 03.12.2024 before the concerned authorities including the SDO, Haldia for taking steps in terms of the West Bengal Public Land (Eviction of Unauthorized Occupants) Act, 1962. However, the same has

not been responded to as yet.

Learned counsel appearing on behalf of the State relies on the report and submits that there is some unauthorized occupation of government land. However, the same does not seem to block the ingress and egress to the petitioner's property.

Learned counsel appearing on behalf of the respondent no.4 submits that his client is not at all connected with the issue at hand.

It appears that a representation dated 03.12.2024 is pending consideration before the SDO, Haldia. In view of the above, let the SDO, Haldia consider the petitioner's representation dated 03.12.2024 in accordance with law and upon hearing all the interested parties as expeditiously as possible, preferably within eight weeks from the date of communication of this order.

It is made clear that the merits of the case have not been gone into.

With these observations, the writ petition is disposed of.

As affidavits were not called for, the allegations made in the writ petition are deemed not to have been admitted. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
